E0470 Respiratory assist device — bi-level, without backup rate

Medicare BiPAP / RAD Documentation Requirements (E0470)

Citations verified against the CMS Medicare Coverage Database · Reviewed September 2026

Respiratory assist devices are covered on a different footing than CPAP: instead of one sleep-study criterion, LCD L33800 defines four disorder pathways — restrictive thoracic disorders, severe COPD, central or complex sleep apnea, and hypoventilation syndrome — each with its own qualifying testing. The documentation has to establish which pathway the patient is on and include that pathway's evidence.

These are the checks AffirmDME runs on every E0470 case, combining the RAD-specific criteria with the universal order and encounter rules.

How this gets reviewed: E0470 is not on CMS's required prior-authorization list — claims are enforced through medical review and ADRs. The record must show the qualifying disorder, its testing, and the sleep-associated symptoms. This guide covers initial claims: continued coverage beyond the first three months requires a re-evaluation no sooner than day 61 showing adherence (average 4+ hours per 24 hours) and benefit.

The requirements, with citations

Every item below is a check AffirmDME runs automatically — this list mirrors the production rules engine, not a paraphrase of the regulations.

Required

Qualifying disorder documented

The record must establish one of the LCD's four pathways: restrictive thoracic disorder, severe COPD, central/complex sleep apnea, or hypoventilation syndrome — and why the item addresses it.

LCD L33800 — RAD coverage criteria
Required

Pathway-specific test results documented

Each pathway has its own qualifying testing — sleep study for CSA/CompSA, blood gases for others. The actual results (not just a mention of testing) must be in the record.

Required

Sleep-associated symptoms in clinical notes

Symptoms characteristic of sleep-associated hypoventilation — daytime hypersomnolence, excessive fatigue, morning headache, cognitive dysfunction, dyspnea — documented by the treating practitioner.

Policy Article A52517 — RAD documentation
Required

Standard Written Order (SWO) on file

A complete written order must exist before the claim is submitted — patient name, item description, quantity, ordering practitioner, and signature.

42 CFR 410.38(d)
Required

Order date and practitioner signature

The SWO must be dated and signed by the treating practitioner. Undated or unsigned orders are treated as no order at all.

42 CFR 410.38(d)
Required

Practitioner NPI on the order

The ordering practitioner's NPI must appear on the order and match PECOS enrollment.

42 CFR 410.38(d)
Required

Face-to-face encounter documented

Chart notes must document an in-person (or permitted telehealth) encounter where the practitioner evaluated the patient for the item.

42 CFR 410.38(d)(2)
Required

Face-to-face within 6 months of the order

The qualifying encounter must have occurred within the 6 months before the order date.

42 CFR 410.38(d)(2)
Required

Medical necessity in the clinical record

The medical record — not just the order — must support why the item is medically necessary for this patient.

CMS PA Documentation Checklist
Required

Length of need documented for rental items

Since the 2020 SWO rule, length of need is no longer a required element of the order itself — but the DME MAC PA portals ask for it, and the record must support the expected duration of use. AffirmDME requires an estimated length of need (1–99 months; 99 = lifetime) on every capped-rental item so the packet never stalls on it.

FAQ

What's the difference between E0470 and E0601 documentation?

E0601 (CPAP) has one gateway: a qualifying sleep study for obstructive sleep apnea under LCD L33718. E0470 (bi-level RAD) is governed by LCD L33800 with four separate disorder pathways, each with its own testing. A CPAP-style file rarely supports a RAD claim as-is.

Does Medicare require prior authorization for BiPAP?

No — E0470 isn't on the required prior-authorization list. Coverage is enforced through medical review and ADRs after submission, so the documentation must be complete before you bill.

What are the continued-coverage requirements?

Beyond the first three months, Medicare requires a re-evaluation no sooner than 61 days after starting therapy, documenting adherence (average use of at least 4 hours per 24-hour period) and clinical benefit. Missing that window is a common way an initially clean claim unravels.
