L3761 Elbow orthosis with locking joint (L3761) and wrist-hand orthosis (L3916), off-the-shelf

Medicare Upper Limb Orthosis Requirements (L3761, L3916)

Citations verified against the CMS Medicare Coverage Database · Reviewed September 2026

Upper limb orthoses are unusual: there is no Local Coverage Determination and no policy article for elbow or wrist-hand braces. Noridian's own checklist says so and points suppliers to the Standard Documentation Requirements article instead. That does not make the documentation lighter — it means the general medical-record rules carry the whole claim.

L3761 and L3916 are the first upper limb codes on the Required Prior Authorization List. CMS is phasing them in by state: New York, Michigan, Florida and California on October 28, 2026; Pennsylvania, Massachusetts, Ohio, Illinois, Texas, Georgia, Arizona and Oregon on January 26, 2027; everywhere else on April 26, 2027. The face-to-face and written-order-prior-to-delivery requirement, by contrast, applies nationwide from October 28, 2026.

How this gets reviewed: Whether a PA request is required depends on the beneficiary's state and the date of delivery — use the PA List lookup on this site with the state to get the exact date. Requests are accepted two weeks before each phase starts. Because there is no item-specific LCD, the reviewer is reading the record for the general elements: the condition, how long it has lasted, whether it is improving, what has been tried, and why a rigid or semi-rigid brace is needed now.

Required

Medical necessity in the clinical record

The contemporaneous record — not a supplier-prepared statement — must document the diagnosis, the duration of the condition, its clinical course, prognosis, and the nature and extent of functional limitation.

Required

Condition summary and prior interventions

Chart notes should say what other treatments have been tried and their results, and the beneficiary's past experience with related items.

Diagnosis codes present

The ICD-10 codes on the claim must match the documented condition.

Face-to-face encounter documented (required from October 28, 2026)

L3761/L3916 (nationwide, not phased) joins CMS's Required Face-to-Face Encounter and Written Order Prior to Delivery List on October 28, 2026. From that date the chart notes must document an in-person (or permitted telehealth) evaluation for the item, and the completed order must reach you before delivery.

42 CFR 410.38(d)(2) — F2F/WOPD list, effective 10/28/2026
Required

Face-to-face within 6 months of the order

The qualifying encounter must have occurred within the 6 months before the order date.

42 CFR 410.38(d)(2)
Required

Standard Written Order (SWO) on file

A complete written order must exist before the claim is submitted — patient name, item description, quantity, ordering practitioner, and signature.

42 CFR 410.38(d)
Required

Order date and practitioner signature

The SWO must be dated and signed by the treating practitioner. Undated or unsigned orders are treated as no order at all.

42 CFR 410.38(d)
Required

Practitioner NPI on the order

The ordering practitioner's NPI must appear on the order and match PECOS enrollment.

42 CFR 410.38(d)
Required

Medical necessity in the clinical record

The medical record — not just the order — must support why the item is medically necessary for this patient.

Required

Length of need documented for rental items

Since the 2020 SWO rule, length of need is no longer a required element of the order itself — but the DME MAC PA portals ask for it, and the record must support the expected duration of use. AffirmDME requires an estimated length of need (1–99 months; 99 = lifetime) on every capped-rental item so the packet never stalls on it.

FAQ

When does L3916 require prior authorization in my state?

October 28, 2026 in NY, MI, FL and CA; January 26, 2027 in PA, MA, OH, IL, TX, GA, AZ and OR; April 26, 2027 in every other state. The same schedule applies to L3761. It is the beneficiary's state that counts.

Is there an LCD for upper limb orthoses?

No. Noridian's documentation checklist states that upper limb orthoses have no published policy and directs suppliers to the Standard Documentation Requirements article (A55426), which is what this guide is built on.

Does the face-to-face requirement phase in too?

No. The July 2026 notice added L3761 and L3916 to the face-to-face and written-order-prior-to-delivery list nationwide on October 28, 2026; only the prior-authorization requirement is phased by state.
